SHIPPING CONDITIONS

The shipment of the goods will take place with different timing depending on the type of goods and destinations.
Once shipped, we will communicate a code for tracking the package.
The prices of the items include VAT.
Shipping costs are always paid by the buyer, both for replacements and for returned goods.

CONDITIONS OF SALE

These General Conditions have as their object the purchase of products and services, carried out remotely via electronic network on the website “www.bianchessi-italia.com” belonging to Bianchessi snc with registered office in Via Donatori di blood, 48 San Paolo ( BS), Italy.
Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, as regards the protection of confidentiality, it will be subject to the regulations set out in Law no. 675/96 and subsequent amendments.

ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The Customer, by sending electronic confirmation of his purchase order, unconditionally accepts and undertakes to observe in his relations with Bianchessi snc., the general and payment conditions transcribed below, declaring to have read and accepted all the information provided to him pursuant to the above-mentioned regulations, also taking note that Bianchessi snc. itself is not considered bound to different conditions unless previously agreed in writing.

CUSTOMER COMMITMENTS

These General Conditions of Sale must be examined online by Customers visiting the site before they confirm their purchases. The forwarding of the order confirmation, therefore, implies total knowledge of the General Conditions of Sale and their full acceptance.
The Customer undertakes and obliges, once the online purchase procedure has been completed, to print and keep these general conditions of sale, already viewed and accepted during the purchase process carried out, in order to fully satisfy the condition set out to the articles 3 and 4 of Legislative Decree no. 185/1999.

PURCHASE METHOD

Purchases of the products, available as illustrated and described online, are made by the Customer at the price indicated therein, to be confirmed when sending the order confirmation, in addition to the transport costs displayed at the time of purchase.
Before confirming the purchase, the Customer will be provided with a summary of the unit cost of each chosen product, the total cost in the case of purchasing multiple products and the related transport costs.
By confirming the purchase, upon completion of the transaction, the Customer will receive an email message containing the date and total amount of their order and the details of the same.

TERMS OF PAYMENT

Payment for the products purchased and the related shipping costs must be made by the customer upon forwarding the order confirmation and in the following 7 days in advance.

Payment by bank transfer

Only when required by the order management computer system, current account holders will be able to use the bank transfer as a payment system. The order will be processed when we see the credit in your current account. In this case, to speed up the process, please send us a copy of the bank account.

Payment by credit card

The banking circuit used is that of Banca Cremasca and Mantovana, cooperative credit.

Payment via PayPal circuit

DELIVERY OF PRODUCTS

The purchased products will be delivered to the address indicated by the Customer, subject to verification of the location by Bianchessi snc.
The delivery of the products by Bianchessi snc may be split, without this entailing any liability for Bianchessi snc.
Indicatively, without this entailing any constraints for Bianchessi snc and subject to the availability of the products on the market as well as any causes of force majeure, the goods will be delivered by Bianchessi snc. to the courier as soon as available, according to the supply times.
Delivery times depend on product availability, shipping methods and the chosen carrier.
The quantities published on the site reflect the availability of Bianchessi snc in the event of a change in such Bianchessi snc availability. will inform the customer by email or by telephone. The customer can alternatively accept the new term or cancel the order and obtain, if he has already made the payment, the refund of the amount without further charges to be borne by Bianchessi snc
The Customer is required to verify that the package is intact, undamaged and in any case complies with the standard characteristics. Only after this verification will the Customer have to accept the delivery, after which he will not be able to make any objection regarding the external characteristics of what was delivered to him in relation to the order placed. However, if there is no correspondence between the order and delivery, according to the methods mentioned above, the customer must accept the goods by signing “with reservation”.

RIGHT OF WITHDRAWAL

1. Pursuant to art. 64 et seq. of the Legislative Decree n. 206/2005, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to Bianchessi snc), has the right to withdraw from the purchase contract for any reason, without any penalty and without prejudice to what is indicated in point 3 below.
2. To exercise this right, the Customer must send an email to info@bianchessi-italia.com explicitly requesting “Withdrawal of the online order” also indicating the bank details necessary to return the sums paid; the system will send the customer a paper form via email which must be printed and sent by registered letter with acknowledgment of receipt within 07 working days from the date of receipt of the goods to: Bianchessi snc., Via Circonvallazione Sud 67/A, Offanengo 26010 (CR ), Italy.

Having received the registered letter, Bianchessi snc. will send the Customer the form for exercising the right of withdrawal via email, complete with authorization number which must be attached to the outside of the packaging in which the product will be physically placed and sent to Bianchessi snc, within 10 working days of authorisation.

3. The right of withdrawal is subject to the following mandatory conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (e.g. accessories, etc.); the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, placing it in a second box; in all cases, affixing labels or adhesive tapes directly to the original packaging of the product should be avoided; the goods subject to the exercise of the right of withdrawal must be returned in a normal state of conservation, as they have been kept and possibly used with the use of normal diligence: therefore, used products which show signs of damage or dirt and which consequently they can no longer be considered intact, simultaneously canceling the request for withdrawal; the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the customer; in the event of damage to the goods during transport, Bianchessi snc will notify the Customer of the incident (within 5 working days of receiving the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain a refund the value of the property (if insured); in this case, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request; Bianchessi snc is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
4. Bianchessi snc. will reimburse the customer the entire amount already paid, as quickly as possible and in any case within 30 days from the date of receipt of the notice of withdrawal, upon receipt of the goods subject to the withdrawal, through a cancellation procedure of the amount charged to the credit card or by bank transfer. In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the refund (ABI Code – CAB – Current Account of the invoice holder).
5. The right of withdrawal is, however, excluded in the case of supply of tailor-made or clearly personalized goods, pursuant to and within the limits of the Legislative Decree (legislative decree) of 6 September 2005 n. 206, article 55 paragraph 2 letter D.

CANCELLATION OF ORDERS BY BIANCHESSI SNC

Bianchessi snc reserves the right to cancel an order or an item in the order no later than 7 working days from the request.

JURISDICTION AND COMPETENT COURT

This contract will be governed by Italian law. For any dispute relating to the validity, interpretation or execution of the same contract, the territorial jurisdiction lies with the judge of the Court of Cremona.

PRIVACY POLICY

Art. 7 Legislative Decree 30 June 2003, n. 196 – Right of access to personal data and other rights.
The interested party has the right to obtain confirmation of the existence or otherwise of personal data concerning him, even if not yet registered, and their communication in an intelligible form.
The interested party has the right to obtain information:
of the origin of the personal data;
of the purposes and methods of processing;
of the logic applied in case of processing carried out with the aid of electronic instruments;
the identification details of the owner, managers and representative designated pursuant to article 5, paragraph 2;
of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representatives in the territory of the State, managers or agents.
The interested party has the right to obtain:
updating, rectification or, when interested, integration of data;
the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
the certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment proves impossible or involves the use of means that are manifestly disproportionate to the protected right.
The interested party has the right to object, in whole or in part:
– for legitimate reasons to process personal data concerning him, even if pertinent to the purpose of the collection;
– to the processing of personal data concerning him for the purposes of sending advertising or direct sales material or for carrying out market research or commercial communication.

INFORMATION PURSUANT TO ART. 13 LEGISLATIVE DECREE 169 OF 06.30.2003

Personal data protection code
Pursuant to art. 7 of Legislative Decree 196/03, at any time, the Customer may send us a written request to update or modify their personal data. With reference to the personal data acquired through registration on the site, necessary for the execution of the online transaction, we inform you that:
– the collection and processing of personal data has the exclusive purpose of allowing the execution of commercial transactions, the object of the Company’s activity, of keeping the Customer informed on related products or services and of complying with the fiscal/tax obligations established by the law, regulations and community legislation;
– under no circumstances are personal data disclosed to third parties for purposes not strictly related to the management of the existing relationship
– in the absence of such data, it is impossible to carry out the commercial transaction;
– all data is processed electronically, electronically and, in particular for data relating to credit card transactions, in encrypted form.
